These Terms of Service ("Terms") govern your use of frontbits.com (the "Site") and any purchase of The Build from Frontbits LLC ("Frontbits," "we," "us," or "our"), a company registered in the Shams Free Zone, United Arab Emirates. By using the Site or booking The Build, you agree to these Terms.
1. The service
The Build is Frontbits' process for delivering custom software. The kickoff call establishes your scope and your price, both of which are confirmed in writing before any work begins. A typical build comprises:
- Four modules, each with full create, read, update and delete functionality
- The workflow connecting those modules
- One or two integrations with third-party tools
- As many screens as those four modules require
- A written scope of work and delivery timeline confirmed before any work begins
- One structured round of revisions before handoff
- Hosting and deployment, so the tool is live, not just handed over
- Full source code and documentation, transferred to you at handover
Work beyond that typical scope, including additional modules or integrations, multi-user roles and permissions, native mobile applications, or ongoing feature work after handover, is scoped and priced individually. The confirmed scope, price, and delivery timeline are set out in writing after the kickoff call and become part of your agreement with us, assuming timely feedback and inputs from you.
2. Payment
Your project's price is confirmed in writing after the kickoff call and is payable in full before any work begins, unless we agree otherwise in writing. Paying reserves your start date; we begin work on that date.
All fees are in US dollars and exclusive of any taxes, which are your responsibility unless we state otherwise in writing. Work falling outside the scope agreed for your project is quoted separately and is not covered by the price you agreed.
3. Cancellation and refunds
You can cancel for a full refund at any time before work begins on your agreed start date. Once work has begun, the fee is non-refundable, except that if Frontbits is unable to deliver the agreed scope, we'll refund the fees paid for the undelivered portion of the work. If we decide on the kickoff call that we're not the right people for your project, we'll refund you in full.
4. Revisions and scope
The Build includes one structured round of revisions, requested and delivered before final handoff. Requests that fall outside the scope agreed for your project are treated as new scope and quoted separately. They're not covered by the included revision round.
5. Your responsibilities
To hit your agreed delivery timeline, we need timely feedback, decisions, and any accounts, content, or access you're responsible for providing. Delays on your side may push back the delivery date without affecting the price.
6. Intellectual property
Until final payment is received, all work product remains the property of Frontbits. Upon full payment, we transfer full ownership of the source code, documentation, and deliverables built for you as part of The Build. Frontbits retains the right to reuse general-purpose components, techniques, and know-how that aren't specific to your project.
7. Use of the Site
You agree to use the Site only for lawful purposes and not to interfere with its normal operation, attempt to access it by unauthorized means, or misuse the contact form or booking widget. All content on the Site, other than materials we've explicitly licensed, belongs to Frontbits.
8. Warranties and liability
We build The Build carefully and stand behind our work, but the Site and any deliverables are provided without warranties beyond what's stated in these Terms or agreed in writing. To the extent permitted by law, Frontbits' total liability arising from The Build or the Site is limited to the amount you paid us, and we are not liable for indirect, incidental, or consequential damages.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Terms already agreed to for an in-progress or completed engagement remain as originally agreed.
10. Governing law
These Terms are governed by the laws applicable in the Shams Free Zone, United Arab Emirates, without regard to conflict-of-law principles.
